Royal Envelope’s Printing Trade Customs
Orders
Written or verbal orders placed with Royal cannot be cancelled without terms meant to compensate Royal for any loss incurred for materials or labor.
Quotations
All quotes are honored for a maximum of 45 days, after which all quotes are subject to review.
Plates
Unless otherwise specified, quotes include printing plates to print one copy. Additional copies are subject to varying plate charges.
Proofs
Unless otherwise specified, up to two Dylux proofs are included in quotes. Additional Dyluxes and all other color proofs are not included in quotations.
Film
Unless otherwise specified, film is not included in any quotes.
Tolerance
Envelope sizes will vary “+” or “-” a sixteenth of an inch. The same applies for the window position.
Condition of Copy
Upon receipt of original copy, should it be evident that condition of the copy differs from that which had been originally described and consequently quoted, the original quotation shall be rendered void and a new quotation issued.
Alterations/Corrections
Customer alterations include all work performed in addition to the original specifications. All such work will be charged at Royal Envelope’s current rates.
Pre-Press Proofs
Royal Envelope will submit pre-press proofs along with original copy for the customer’s review and approval. Proofs will be returned to Royal marked “OK or “OK with corrections” and signed by the customer. If revised proofs are desired, request must be made when proofs are returned. Royal Envelope can not be held responsible for errors under the following conditions: proofs are not required by the customer, the work is printed per the customer’s “OK”, requests for changes are communicated orally or if the customer has failed to return proofs with indication of changes.
Press Proofs
Press proofs will not be furnished unless they have been required in writing in Royal’s quotation. A press sheet can be submitted for the customer’s approval as long as the customer is present at the press during make-ready. Any press time lost or alterations/corrections made because of the customer’s delay or change of mind will be charged at Royal’s current rates.
Customer’s Property
Royal Envelope will only maintain fire and extended coverage on property belonging to the customer while the property is in Royal’s possession. Royal’s liability for this property will not exceed the amount recoverable from the insurance. Additional insurance coverage may be obtained if it is requested in writing, and if the premium is paid to Royal.
Customer-Furnished Materials
Materials furnished by customers or their suppliers are verified by delivery tickets. Royal Envelope bears no responsibility for discrepancies between delivery tickets and actual counts. Customer-supplied paper must be delivered according to specifications furnished by Royal. These specifications will include correct weight, thickness, pick resistance, and other technical requirements. Artwork, film, color separations, disks, special dies, tapes, or other materials furnished by the customer must be usable by Royal without alteration or repair. Items not meeting this requirement will be repaired by the customer, or by Royal at our current rates.
Over-Runs and Under-Runs
Over-runs and under-runs not to exceed 20% on quantities of 1000 to 9999 and not to exceed 10% on quantities of 10,000 to 49,999 and not to exceed 5% on quantities of 50,000 to 249,999 and not to exceed 3% on quantities of 250,000 to 999,999 and not to exceed 2% of the quantities over 1,000,000, or the percentage agreed upon, shall constitute acceptable delivery. Customer will be billed for actual quantity delivered within this tolerance. If the customer requires exact quantities, then a new price must be quoted for the job.
Terms
Payment shall be whatever was set forth in quotation of invoice unless otherwise provided in writing. Claims for defects, damages, or shortages must be made by the customer in writing within a period of fifteen days after delivery of all or any part of the order. Failure to make such claim within the stated period shall constitute irrevocable acceptance and an admission that they fully comply with terms, conditions, and specifications.
Liability
- Disclaimer of Express Warranties. Royal Envelope warrants that the work is as described in the purchase order. The customer understands that all sketched, copy, dummies and preparatory work shown to the customer are intended to illustrate the general type and quality of the work. They are not intended to represent the actual work performed.
- Disclaimer of Implied Warranties. Royal Envelope warrants only that the work will conform to the description contained in the purchase order. Royal’s maximum liability, whether by negligence, contract, or otherwise, will not exceed the return amount invoiced for the work dispute. Under no circumstances will Royal Envelope be liable for specific, individual, or consequential damages.
Indemnification
The customer shall indemnify and hold harmless Royal Envelope from any and all loss, cost, expense, and damages (including court costs and reasonable attorney fees) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against Royal Envelope on grounds alleging that the said printing violates any copyrights or any proprietary right of any person, or that it contains any matter that is libelous or obscene or scandalous, or invades any person’s right to privacy or other personal rights, except to the extent that Royal Envelope contributed to the matter. The customer agrees, at the customer’s own expense, to promptly defend and continue the defense of any such claim, demand, action, or proceeding that may be brought against Royal Envelope, provided that Royal Envelope shall promptly notify the customer with respect thereto, and to provide further that Royal Envelope shall give the customer such reasonable time as the exigencies of the situation may permit in which to undertake and continue the defense thereof.
